PROTECTION VISA (SUBCLASS 866)

Overview

Protection visa is for individuals who are currently in Australia and wishing to apply for protection.

This visa allows the person to:

  • Live, study, and work in Australia indefinitely;
  • Register in Medicare ad Centrelink, Australia’s government services;
  • Propose family members for permanent residence through the offshore Humanitarian Program;
  • Travel in and out of Australia for five (5) years;
  • Take free English language classes for 510 hours;
  • Apply for citizenship in Australia, if qualified.

Things to consider when applying for this visa:

  • Processing
    • Processing time may months or, for some cases, years, but the Cornerstone Migration team will exert best efforts to get it in less than the stated months.
    • Be mindful when filling the application. Avoid errors when inputting data, and always check documents to be included.
    • Pay the correct visa application charges. Application will not be process if the applicant has not paid the costs.
  • Eligibility
    • Arrived in Australia legally.
    • Should be a refugee or pass the complementary protection criteria.
    • Not have encountered the following:
      • Have been refused protection visa or had protection visa cancelled since arriving to Australia.
      • National of 2 or more countries.
      • Have protection in a prescribed safe third country.
    • Have not held any of the visa listed below:
      • Temporary Protection visa (785)
      • Temporary Safe Haven visa (449)
      • Temporary visa – Humanitarian concern (786)
      • Safe Haven Enterprise visa (790)
    • Meet identity, security, health, and character requirements
