SKILLED EMPLOYER SPONSORED REGIONAL (PROVISIONAL) VISA (SUBCLASS 494)

EMPLOYER SPONSORED STREAM

Employer Sponsored stream allows employers to sponsor overseas workers to live and work in regional Australia on a temporary basis. This visa is designed to assist regional employers who are unable to meet their skilled Australian workforce needs from the local labour market.

This visa allows the person to:

  • Stay, work, and study in specific regional areas of Australia for 5 years;
  • Travel in and out of Australia while visa is active;
  • Apply for permanent residence after three years from the date the visa was granted, if qualified.

Things to consider when applying for this visa

When applying for this visa, the applicant is advised to read the following:

  • Processing
    • Processing time depends on the situation, but the Cornerstone Migration team will exert best efforts to get it in less than the stated months.
    • Be mindful when filling the application. Avoid errors when inputting data, and always check documents to be included.
    • Pay the correct visa application charges. Application will not be process if the applicant has not paid the costs.
  • Eligibility
    • Aged under 45 years old, however there may be exceptions.
    • Nominated by an employer with a lawfully operating establishment or company in Australia.
    • Possess skills, qualifications and work experience needed to perform the nominated occupation. Also have three (3) years of full-time experience (or the part-time equivalent) in the nominated occupation
    • Have skills assessed as suitable for your nominated occupation by an assessing authority.
    • Extensive English Language skills and obtain at least one English language test results.
    • Meet any mandatory licensing, registration, or professional membership requirements
    • Meet the health and character requirement.

Sponsor:

  • Eligibility (Sponsor)
    • Be actively and lawfully operating in Australia.
    • Nominate the possible skilled worker for the eligible occupation.
    • Inability to find an Australian citizen or permanent resident who may be suitable for the nominated position.
    • Pay the nominee an annual salary less than AUD250,000.
    • Have the nominee be in a written contract of employment to work under nominator’s business or associated entity of the nominator’s business.

 

LABOUR AGREEMENT STREAM

Labour Agreement stream allows skilled workers be nominated by employers to enter in a Labour Agreement. The said agreement is developed by a department in the Australian Government and employers.

This visa allows the person to:

  • Stay, work, and study in specific regional areas of Australia for 5 years;
  • Travel in and out of Australia while visa is active;
  • Apply for permanent residence after three years from the date the visa was granted, if qualified.

Sponsor:

  • Eligibility (Sponsor)
    • Be actively and lawfully operating in Australia
    • Seek to fill occupations not available under other visa programmes (such as the Employer Sponsored SESR stream).
    • Show proof that the business can meet salary and employment conditions agreed in the labour agreement.
    • Demonstrate a labour market need for the occupation in the business and the position(s) cannot be filled through the local labour market, through labour market testing and key stakeholder consultation.
    • address any concessions sought, if permitted (e.g. salary, English language, skills, qualifications, work experience) and
    • apply for and be permitted a suitable type of Labour Agreement (Company-specific, Industry, Designated Area Migration Agreement (DAMA), Project Agreement (PA) or, Global Talent Stream (GTS) Agreement) before any positions or visas may be lodged for processing.

Cost:

Employer Sponsored and Labour Agreement stream incurs the following:

  • Main applicant: AUD4,045
  • Dependents who are 18 years old or above: AUD2,025
  • Dependents who are below 18 years old: AUD1,010
  • Dependents who are 18 years old with no functional English: AUD4,890

Note for cost:

    • There are also other payments, not part of the costs mentioned above, for English language tests, health checks, biometrics, and police certificates.
