Student visa changes from 2 October 2026: what students and families need to know
Rules effective 2 October 2026 | Updated 4 October 2026
If you are planning further study or hoping to bring your partner or children to Australia, the new Student visa rules may affect your next application. We understand there may already be course fees, travel plans and family commitments involved.
First, some reassurance: these reforms do not cancel your current Student visa. You must still follow its conditions and expiry date. Applications lodged before 2 October 2026 continue under the earlier rules.
What has changed?
1. Applying for another Student visa in Australia is more restricted
Current Student visa holders applying again as the main student generally need to apply from outside Australia unless an exemption applies. This also affects Student visa dependants who want to become the main student applicant.
Possible exemptions for eligible primary Student visa holders include:
- Doctoral studies.
- School students and Defence or Foreign Affairs students.
- Finishing the principal course, or an eligible alternative principal course with the same provider, within the permitted timeframe.
- Completing the principal course and progressing to an eligible further qualification. Higher education, qualification level and course-enrolment requirements apply.
- Continuing studies after an education provider defaults, subject to time limits and other conditions.
These are conditional exemptions. A new enrolment alone does not establish eligibility to apply in Australia.
2. More temporary visa holders must apply offshore
The restricted list now includes holders of subclass 400, 407, 408, 417, 457, 462 and 482 visas, alongside existing categories such as Temporary Graduate and Visitor visas. The full list also includes specified 403 and 995 visa holders and other categories. Do not assume a work or working holiday visa can be changed to a Student visa without leaving Australia.
If the rules require you to apply outside Australia, you must also be outside Australia when the Student visa is granted. These reforms also affect certain Student Guardian visa applications.
3. Bringing a partner or children is more restricted
Family members can be included in a new Student visa application only where an exemption applies. Examples include eligible doctoral students, Defence or Foreign Affairs students, students whose courses are fully funded by a foreign government, and qualifying passport holders from Pacific or specified ASEAN countries.
Protections also exist for certain existing family members and children born in Australia. The exact visa history, location and relevant dates matter. Eligible family applications must be made at the same time and place as the student’s application.
For new applications from 2 October 2026, family members cannot use the Student visa subsequent-entrant pathway to join after the student’s visa has been granted. Applications already lodged before commencement are treated under the earlier rules.
What should you do now?
- Check your visa expiry date and conditions.
- Have your current visa, course history and Confirmation of Enrolment reviewed before paying for another course.
- Check your partner’s and children’s position before arranging travel or relying on them joining later.
- If an application is already lodged, confirm its lodgement date before assuming the new rules apply.
You do not need to make a rushed decision based on a headline. At Cornerstone, we can help you understand which rules affect you, whether an exemption may apply and what needs attention next.
